The Consumer Financial Protection Bureau (CFPB) has sued Walmart and fintech firm Branch Messenger. The lawsuit alleges they forced Spark delivery drivers to use specific accounts for pay deposits. Drivers allegedly paid over $10M in fees to transfer funds to preferred accounts. The CFPB says this violated federal law between 2021 and 2023. Walmart denies the claims, calling the CFPB’s investigation rushed and unfair.
The CFPB claims Walmart misled drivers about how quickly they could access earnings. Drivers were promised same-day access but faced delays and complicated steps. CFPB Director Rohit Chopra criticized “junk fees” that drained earnings. The suit also alleges that workers who refused Branch accounts risked termination. Branch, linked to Evolve Bank & Trust, also faces accusations of failing to meet federal standards for consumer account management.
Walmart strongly denies the allegations. A spokesperson said the CFPB’s lawsuit included errors and misrepresented legal principles. They claim the investigation overlooked Walmart’s perspective. Branch echoed Walmart, stating the CFPB omitted key facts and rushed the lawsuit to gain media attention. Both companies pledged to fight the claims in court. This dispute casts a shadow on Walmart's Spark delivery service, even as Walmart continues to dominate grocery e-commerce, capturing 40% of online grocery spending in Q2 2024.
This lawsuit could hurt Walmart’s image among Spark drivers and customers. Independent contractors rely on prompt and fair pay, and any mistrust can weaken loyalty. The Spark platform, essential for Walmart’s e-commerce strategy, faces increased scrutiny. Analysts wonder if the legal battle will disrupt Walmart’s operations.
